Cyber Report | April 12th, 2024

It's been a busy week in privacy, cybersecurity, and AI policy in DC. Last weekend, top congressional committee leadership released a discussion draft of highly anticipated bipartisan, bicameral data privacy legislation – the American Privacy Rights Act. The legislation includes consensus around two key sticking points that have held up the negotiations for several years - private right of action and federal preemption. Also on Capitol Hill, Sen. Wyden has introduced legislation related to federal security standards, while Rep. Schiff is leading legislation on transparency in generative AI.

Separately, DoD, GSA, and NASA have published a request for information to solicit feedback on the newly established Federal Acquisition Regulation (FAR) Part 40, which is focused on managing acquisition requirements related to information security and supply chain security. Furthermore, National Security Agency (NSA) released new guidance for maturing data security and protecting data access in zero trust environments.
